Decision of the Ministry of Commerce on the Succession of Anti-Dumping Duty Rates by Relevant Enterprises Regarding Import Copolymer Polyoxymethylene Originating from the Republic of Korea, Thailand, and Malaysia
On April 17 and April 22, 2026, the Ministry of Commerce received applications from Daicel HPP Malaysia Sdn. Bhd. and KOLON INDUSTRIES, INC., respectively. The aforementioned companies requested to inherit the anti-dumping duty rates and other rights and obligations applicable to Polyplastics Asia Pacific Sdn. Bhd. and KOLON ENP, INC., respectively, in the anti-dumping measures on Polyoxymethylene Copolymer originating in the Republic of Korea, Thailand, and Malaysia. The Ministry of Commerce conducted an investigation regarding this and made a decision on the succession of duty rates. The relevant matters are hereby announced as follows:
I. Applicable Duty Rates of Original Companies
On October 23, 2017, the Ministry of Commerce issued Announcement No. 61 of 2017, deciding to impose anti-dumping measures on imported Polyoxymethylene Copolymer originating in the Republic of Korea, Thailand, and Malaysia for a period of 5 years. On October 23, 2023, the Ministry of Commerce issued Announcement No. 38 of 2023, deciding to continue to levy anti-dumping duties on imported Polyoxymethylene Copolymer originating in the Republic of Korea, Thailand, and Malaysia for a period of 5 years. In the aforementioned anti-dumping measures, the anti-dumping duty rate applicable to Polyplastics Asia Pacific Sdn. Bhd. was 8.0%, and the rate applicable to KOLON Plastics Corp. was 6.2%. On June 20, 2024, the Ministry of Commerce issued Announcement No. 22 of 2024, deciding that KOLON ENP, INC. shall inherit the anti-dumping duty rate and other rights and obligations applicable to KOLON Plastics Corp. in the anti-dumping measures on Polyoxymethylene Copolymer. Currently, the anti-dumping duty rate applicable to Polyplastics Asia Pacific Sdn. Bhd. is 8.0%, and the rate applicable to KOLON ENP, INC. is 6.2%.
II. Investigation Procedure
On April 17, 2026, Daicel HPP Malaysia Sdn. Bhd. submitted an application to the Ministry of Commerce, stating that due to a restructuring through absorption spin-off by its parent company, Polyplastics Asia Pacific Sdn. Bhd. has been renamed as Daicel HPP Malaysia Sdn. Bhd. Daicel HPP Malaysia Sdn. Bhd. requested to inherit the rights and obligations of Polyplastics Asia Pacific Sdn. Bhd. in the anti-dumping measures on Polyoxymethylene Copolymer from the Republic of Korea, Thailand, and Malaysia. Daicel HPP Malaysia Sdn. Bhd. also submitted resolutions of the board of directors and shareholders regarding the absorption spin-off; business licenses and enterprise registers before and after the renaming, articles of association, lists of shareholders and directors, production equipment and processes, raw material suppliers and sales customers, related party information, production capacity and output, and relevant notarized materials.
On April 22, 2026, KOLON INDUSTRIES, INC. submitted an application to the Ministry of Commerce, stating that KOLON ENP, INC. has been absorbed and merged by its parent company, KOLON INDUSTRIES, INC. KOLON INDUSTRIES, INC. requested to inherit the rights and obligations of KOLON ENP, INC. in the anti-dumping measures on Polyoxymethylene Copolymer from the Republic of Korea, Thailand, and Malaysia. KOLON INDUSTRIES, INC. also submitted resolutions of the board of directors and shareholders regarding the merger, merger agreement, business licenses and enterprise registers before and after the renaming, articles of association, lists of shareholders and directors, production equipment and processes, raw material suppliers and sales customers, related party information, production capacity and output, and relevant notarized materials.
The Ministry of Commerce notified the domestic Polyoxymethylene Copolymer industry of the aforementioned applications. The domestic Polyoxymethylene Copolymer industry raised no objection to this.
III. Decision on Succession of Duty Rates
Upon review, the Ministry of Commerce considers that the applications of the aforementioned companies meet the requirements and are accompanied by corresponding evidence. The companies' production equipment, production capacity, supplier relationships, customer base, sales channels, and operational management regarding Polyoxymethylene Copolymer have not undergone substantive changes after the renaming.
Accordingly, the Ministry of Commerce decides:
(1) Daicel HPP Malaysia Sdn. Bhd. shall inherit the 8.0% anti-dumping duty rate and other rights and obligations applicable to Polyplastics Asia Pacific Sdn. Bhd. in the anti-dumping measures on Polyoxymethylene Copolymer.
(2) KOLON INDUSTRIES, INC. shall inherit the 6.2% anti-dumping duty rate and other rights and obligations applicable to KOLON ENP, INC. in the anti-dumping measures on Polyoxymethylene Copolymer.
(3) For Polyoxymethylene Copolymer exported to China under the name of Polyplastics Asia Pacific Sdn. Bhd., the 9.5% anti-dumping duty rate applicable to "other Malaysia companies" in the anti-dumping measures on Polyoxymethylene Copolymer shall apply.
(4) For Polyoxymethylene Copolymer exported as China under the name of KOLON ENP, INC., the 30.4% anti-dumping duty rate applicable to "other Korea companies" in the anti-dumping measures on Polyoxymethylene Copolymer shall apply.
IV. This announcement shall be effective as of June 5, 2026
